
Terms & Conditions
By using the services of Welkies Logistics (“Welkies”, “we”, “us”, or “the Carrier”), the customer (“Merchant”) agrees to be bound by the following Terms & Conditions, which govern all shipping and logistics services provided by Welkies.
1. Definitions
1. Carriage means the whole or any part of the transportation, loading, unloading, handling, storage, and all related services undertaken by Welkies in relation to the Goods.
2. Carrier means Welkies Logistics.
3. Freight includes all charges payable to Welkies in accordance with applicable tariffs unless otherwise stated.
4. Goods means the whole or any part of the cargo accepted for shipment, including packaging and any container not supplied by Welkies.
5. Merchant includes the shipper, consignee, receiver, holder of the Goods, owner, or any person acting on behalf of such persons.
6. Person includes an individual, corporation, or other legal entity.
7. Subcontractor includes any third-party service provider, agent, or partner engaged by Welkies to perform any part of the Carriage.
8. Terms & Conditions refers to all provisions, rights, obligations, limitations, and clauses contained herein.
9. Vessel means any waterborne craft used in the Carriage, whether feeder or ocean vessel.
2. General Terms

All Goods submitted for shipping must comply with applicable local and international transportation, customs, aviation, and maritime laws.

The Merchant is solely responsible for providing accurate shipment details, including description, weight, value, and contents of the Goods.

Payments shall only be deemed valid when made through Welkies’ designated payment channels and supported by an official receipt.

The Merchant shall not modify any shipping address provided by Welkies. Welkies shall not be liable for loss arising from incorrect address entries supplied to vendors or suppliers.
3. Inspection of Goods

Welkies reserves the right, but is not obligated, to open, scan, inspect, weigh, or measure any package or container at any time.

If Goods cannot be safely or lawfully carried, Welkies may, without notice, take any reasonable action including storage, repacking, continuation, abandonment, sale, or disposal of the Goods.

Such action shall constitute due delivery, and all related costs shall be borne by the Merchant.

Welkies shall not be liable for any loss, delay, or damage arising from actions taken under this clause.
4. Prohibited & Restricted Goods

Welkies strictly prohibits the shipment of the following items without proper documentation or approval:

Weapons, explosives, flammables
-
Drugs or controlled substances
-
Chemicals, toxic or hazardous materials
-
Liquids, powders, gases
-
Counterfeit goods
-
Contraband items
-
Cash, jewelry, or undeclared high-value items
2. Required documentation may include MSDS, Ocean Transport Safety Certificates, or Test Reports.
3. Failure to provide required documentation shall result in inspection, penalties, refusal, or disposal of the Goods at the Merchant’s expense.
5. Legal Action Clause
If illegal, undeclared, or prohibited Goods are discovered:

Welkies reserves the right to hand the matter over to law enforcement authorities.

Legal action may be pursued against the Merchant.

All shipments under the Merchant’s name may be suspended permanently.

No refund shall be issued.
6. Freight, Charges & Payment Terms
-
Freight is fully earned upon loading of the Goods and is non-refundable.
-
Base advertised rates apply only to normal/light cargo of 1 CBM and above.
-
Higher rates apply to:
-
High-value goods
-
Machinery and equipment
-
Vehicles, motorcycles
-
Goods with batteries, liquids, gas, powder
-
Baby diapers, televisions, and goods packed in bales
4. Heavy cargo: 1 CBM = 500kg; forklift handling fees apply.
5. Packages below 1 CBM are charged at higher rates.
6. Minimum charge applies to packages 0.05 CBM and below.
7. Consolidation (repacking) services are available at an additional fee.
8.All invoices must be paid in full within 14 days of issuance or no later than one week before container arrival, whichever comes first.
9. Failure to pay within the stipulated time may result in forfeiture of doorstep delivery, interest charges, service fees, and recovery costs.
7. Weight, Size & Misrepresentation

The Merchant must adhere to Welkies’ maximum weight and size limits.

Any excess weight or misrepresentation shall attract additional charges, penalties, or refusal of shipment.
8. Packaging & Handling
-
Merchants are responsible for proper and secure packaging of Goods. All fragile goods must be properly secured in a wooden frame or wooden case prior to shipment.

Welkies Logistics may repackage unsafe Goods at the Merchant’s expense.
-
Welkies Logistics shall not be liable for loss or damage resulting from inadequate packaging.
9. Delivery, Storage & Disposal
-
The Merchant must take delivery within 18 working days after notification of customs clearance.
-
Storage fees apply after the free period at Ghc 20/CBM/day.
-
Goods unclaimed after 180 days may be disposed of without notice, and any amount derived shall be applied toward settling all associated costs incurred by the Merchant.
-
Refusal to take delivery constitutes a waiver of any claims against Welkies.
10. Estimated Timelines
-
Container loading occurs every 10–14 days.
-
Estimated Time of Arrival (ETA) is provided by shipping lines and may change without notice.
-
Customs clearance timelines are estimated at 7–14 days, subject to external authorities.
11. Insurance
-
Merchants are strongly advised to purchase insurance for heavy, high-value, or sensitive goods. Where goods are not insured and are lost during transportation, the liability of Welkies Logistics shall be strictly limited to a maximum of twice (2x) the freight cost of the lost goods only. Welkies Logistics shall bear no further responsibility for the value of uninsured goods beyond this limit.

Uninsured Goods are shipped entirely at the Merchant’s risk.
12. Liability & Limitations
Welkies shall not be liable for:

Force majeure events, natural disasters, or government seizures

Delays caused by customs, airlines, ports, or third parties
-
Undeclared or misdeclared Goods
-
Loss arising from Merchant negligence or non-compliance
13. Merchant’s Warranties & Responsibilities
The Merchant warrants that:

They are the lawful owner of the Goods or authorized to ship them.
-
Goods comply with all applicable laws and regulations.
-
Goods are not intended for nuclear, chemical, or biological weapons.
-
All customs declarations are lawful, accurate, and timely.
-
All persons defined as Merchant are jointly and severally liable for obligations under these Terms.
14. Dispute Resolution

Parties shall attempt amicable resolution first.
-
Unresolved disputes shall be referred to arbitration or the appropriate legal jurisdiction.
15. Amendments
Welkies Logistics reserves the right to amend these Terms & Conditions at any time. Updated versions shall take effect upon publication.
Acceptance
By submitting Goods to Welkies Logistics, the Merchant acknowledges and accepts these Terms & Conditions in full.
